1. Account Usage

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

2. Ordering and Delivery

2.1 Order Acceptance

All orders placed through the App are subject to acceptance by the relevant Foodies branch. We reserve the right to cancel or refuse any order for reasons such as product unavailability or delivery constraints.

2.2 Delivery Estimates

Any delivery times provided are estimates only. While we strive to meet these times, delays may occur due to traffic, weather, or high order volume.

2.3 User Availability

It is your responsibility to be available at the designated delivery address to receive your order. If you are unavailable, the order may be cancelled without a refund.

3. Payments and Pricing

3.1 Pricing

All prices are displayed in the App and are inclusive of applicable taxes unless stated otherwise. Delivery fees are calculated based on your distance from the selected branch.

3.2 Method of Payment

Payment must be made through the App using the provided payment gateways. By using these services, you agree to comply with the terms of the respective payment processors (e.g., Stripe, JazzCash).

4. Loyalty Program

4.1 Points Accumulation

Users may earn loyalty points on eligible purchases. The rate of accumulation and eligibility criteria are determined solely by Foodies.

4.2 Redemption

Loyalty points have no cash value and can only be redeemed within the App for discounts or rewards as specified. Points are non-transferable and may expire according to program rules.

5. Intellectual Property

The App, including its design (Noir system), code, graphics, and content, is the property of Foodies and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive license to use the App for personal, non-commercial purposes.

6. Limitation of Liability

Foodies shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. We provide the service “as is” and “as available” without any warranties.

7. Modifications

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting in the App. Your continued use of the App signifies your acceptance of the revised terms.

8. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App operates.
